Post Order Modification Lawyer in Monterey
As part of your divorce or separation, courts establish an order to cover child custody and visitation rights, spousal support, and other issues regarding how the parties will move forward. If circumstances change and the order no longer reflects your current reality, the court can revisit the issues and modify the arrangement.
At my law offices, I assist clients in post divorce modification matters. I have substantial experience in family law, divorce and separation issues and I can help you by explaining your options and representing your interests. I aim to assist families by handling family law matters through family court, mediation and the collaborative law process. Call 831-372-3058 to schedule a consultation to discuss the modification of your divorce decree.
Small changes will not justify the modification of a court order. Only a substantial change in circumstances will cause a court to revisit the arrangement currently in place. Typically, modifications concerning child custody and child support issues are based on a change in job status, or physical relocation. If one party has a significant change in their financial picture, child support may be amended. If one party is moving away, an order for children to spend weekends with one parent and the work week with another would no longer be practical.
I can help you formulate a new plan and seek the court's approval to modify the existing order. I can also represent you if your former partner is seeking a modification that you do not support. I often recommend mediation or collaborative law as an alternative to modifying your custody and support arrangement. When alternative dispute resolution is not applicable to your legal matter, I can represent you in court to protect your interests and the interests of your children. Whatever your case requires, I have the experience and compassion to help you manage your family law needs.
